Dispute Resolution - auDRP

If a third party is infringing on your business name, brand or product name, we can assist you with strategies and procedures to recover this domain name
An evaluation is the first step to determine the extent of the infringement and to determine that an infringement has actually been committed.

We can then send a cease and desist letter to notify the party that they may be infringing on your trademark rights and demand that they immediately cease this activity.

If the initial cease and desist letter is either ignored by the infringing party or challenged, then a threat of a DRP action is the next escalation point.

The final step would be to file a complaint through the  au Dispute Resolution Process (auDRP).  The purpose of the auDRP is to provide a cheaper, speedier alternative to litigation for the resolution of disputes between the registrant of a .au domain name and a party with competing rights in the domain name.

The proceedings are typically concluded within three months of lodgement.  Web IP will then case manage you through the proceeding and will utilize our experience and strategies  to give you the best chance of being successful through this route.
